Discussion and Legislative Suggestions on Improving Legal Protection of Spousal Rights
Abstract
This paper examines the current legal framework concerning the protection of personal rights and partnerships in China, with a focus on the need for legislative improvements to accommodate diverse social structures. By analyzing the interplay of biological, psychological, and societal factors in human relationships, it highlights the growing demographic diversity in contemporary society and identifies gaps in existing legal protections. The study discusses the challenges of revising traditional legal statutes and proposes the development of specialized legislation to address these gaps.
Key principles for such legislation include ensuring equitable rights, clarifying legal protections, and adhering to democratic governance standards. The paper elaborates on potential legislative components, covering areas such as partnership registration, property rights, healthcare access, mutual support obligations, and dispute resolution mechanisms. These measures aim to foster a more inclusive and harmonious societal framework.
Finally, the study emphasizes the importance of a scientifically grounded, pragmatic approach to legislation, considering multifaceted social and cultural factors to ensure effective implementation.
